NOTICE OF VOLUNTARY MORTGAGE FORECLOSURE SALE
Date: December 20, 2013
YOU ARE NOTIFIED THAT:
1. A default has occurred in the conditions of that certain real estate mortgage executed by P & A Properties, LLC, a Minnesota limited liability company, as mortgagor, in favor of First State Bank of Wyoming, a Minnesota banking corporation, as mortgagee, dated November 17, 2004, and recorded on December 29, 2004, as Document No. 3489363, as modified by that certain real estate mortgage modification agreement dated August 28, 2008, and recorded on September 11, 2008, as Document No. 3707441, both in the Office of the County Recorder in and for Washington County, Minnesota (collectively, Mortgage). The land described in the Mortgage is not registered land.
2. The original or maximum principal amount secured by the Mortgage was:
$762,666.26.
3. No action or proceeding at law is now pending to recover the debt secured by the Mortgage or any part thereof.
4. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage and all notice and other requirements of applicable statutes.
5. At the date of this notice, the amount due on the Mortgage is: $1,010,628.11.
6. Pursuant to the terms and conditions of that certain voluntary foreclosure agreement dated October 16, 2013, and recorded on October 21, 2013, as Document No. 3968763, in the Office of the County Recorder in and for Washington County, Minnesota (Agreement), the Mortgage shall be foreclosed, and the land located at 131 North Lake Street, Forest Lake, Minnesota 55025, Property Tax ID No. 08-032-21-12-0218, and legally described as follows:
Lot 4, Block 26, FOREST LAKE, Washington County, Minnesota, except that part lying East of a line bearing South 5 degrees 38 minutes 23 seconds West from the Northwest corner of Lot 2, Rearrangement of Lots 1, 2 and 3, Block 26, FOREST LAKE. The North line of Lot 2 having an assumed bearing of East.
And Except that part of Lot 4, Block 26, VILLAGE OF FOREST LAKE, Washington County, Minnesota, described as follows: Commencing at the northwest corner of said Lot 4; thence Easterly along the North line of said Lot 4, a distance of 102.84 feet, to the point of beginning; thence Southerly at a right angle, a distance of 3.5 feet, thence Easterly at a right angle, a distance of 29.16 feet, thence Northerly at a right angle a distance of 3.5 feet to the North line of said Lot 4; thence Westerly along said North line to the point of beginning. AND EXCEPT
That part of Lot 4, Block 26, VILLAGE OF FOREST LAKE, Washington County, Minnesota, lying Northerly of the following described Line A; Line A is described as follows: Commencing at the Northwest corner of said Lot 4; thence Southerly along the Westerly line of said Lot 4, a distance of .050 feet, to the point of beginning; thence Easterly to a point on the North line of said Lot 4, distant 102.84 feet Easterly of the Northwest corner of said Lot 4 and there terminating.

That part of Lot 5, Block 26, of the recorded plat of FOREST LAKE, Washington County, Minnesota, described as follows:
Commencing at the Northwest corner of said Lot 5; thence North 89 degrees 51 minutes 26 seconds East, assumed bearing along the North line of said Lot 5 a distance of 77.07 feet to the point of beginning of the parcel to be described; thence South 00 degrees 08 minutes 34 seconds West a distance of 0.60 feet; thence North 89 degrees 51 minutes 26 seconds East, a distance of 18.55 feet; thence North 00 degrees 08 minutes 34 seconds East, to the North line of said Lot 5; thence Westerly along said North line to the point of beginning (Property),
shall be sold by the Sheriff of Washington County, Minnesota, at public auction on January 24, 2014, at 10:00 a.m., at the Washington County Sheriffs Office: 15015 62nd Street North, Stillwater, Minnesota 55082.
7. The time allowed by law for redemption by mortgagor or mortgagors personal representatives or assigns is two (2) months after the date of sale.
8. Each holder of a junior lien on the Property may redeem in the order and manner provided in Minn. Stat. 582.32, subd. 9, beginning after the expiration of mortgagors redemption period as set forth herein.
9. The mortgagor released from financial obligation on the Mortgage is: None.
