In Relation to Certificate of Title No. 35339 Issued for land in the County of Washington and State of Minnesota and legally described as follows:
The Northeast Quarter of the Northwest Quarter (NE 1/4 of NW 1/4) of Section Twelve (12), Township Twenty-seven (27) North, Range Twenty-one (21) West
Excepting All that part of the North Half of the Northwest Quarter (N 1/2 NW 1/4), of Section Twelve (12), Township Twenty-seven (27) North, Range Twenty-one (21) West, bonded and described as follows: Commencing at a point on the North line thereof where the Easterly boundary of Main Street in the Village of Cottage Grove extended Northerly intersects said North line; thence East on the North Line thereof, 660 feet; thence South and parallel to the East line of said Road, 693 feet; thence West and parallel to the North line of said tract, 660 feet to the East line of said Main Street, extended Northerly; thence North on the East line of said Main Street, extended Northerly, to the place of beginning containing Ten (10) acres, more or less. EXCEPTING ALSO:
The West 101.00 feet of the North 1108 feet of the Northeast 1/4 of the Northwest 1/4 of Section 12, Township 27 North, Range 21 North, City of Cottage Grove, Washington County, Minnesota, except that part of said Northeast 1/4 lying westerly of the following described line: Commencing at the North 1/4 corner of Section 12, thence South 89 degrees 32 minutes 54 seconds West along the North line of Section 12 a distance of 1266.42 feet to the point of beginning of said line, this point also being 660 feet East of the intersection of the North line of Section 12 and the Easterly line of Lamar Avenue extended Northerly; thence South 07 degrees 48 minutes 14 seconds West 447.09 feet to the West line of said Northeast 1/4 there terminating. Subject to the rights of County Road No. 20 on the North side, containing 2.23 acres more or less (the Certificate Description).
Herbert W. Jones, Jr., Roderick Daniel Jones, David Griffith Jones, and all other heirs of Herbert W. Jones, Jr., Roderick Daniel Jones and David Griffith Jones claiming any right, title, estate, interest or lien in the real estate described herein; Texaco, Inc, MN Land Acquisitions, LLC and County of Washington:
Upon receiving and filing the Report of Examiner of Titles in the above-entitled matter, IT IS ORDERED, that you, and all persons interested, appear before this Court on the 9th day of January, 2017 at 9:00 am in the Washington County Government Center, 14600 61st Street, Stillwater, MN, and then, or as soon thereafter as the matter can be heard, show cause, if there is any, why this Court should not enter an Order as follows:
That the Registrar of Titles, upon the filing with the Registrar of a certified copy of this Order, cancel Certificate of Title No. 35339 and enter a new Certificate of Title for the land therein described in favor of McHattie Farms, Inc., a Minnesota Corporation, 9119 Military Road, Cottage Grove, to issue a new certificate for the following description:
The Northeast Quarter of the Northwest Quarter (NE 1/4 of NW 1/4) of Section Twelve (12), Township Twenty Seven (27) North, Range Twenty One (21) West EXCEPT the West 101 feet of the North 1108 feet of the North 1108 feet thereof.
Subject to the existing recital and the memorials of document numbers 19050, and a judicial determination whether or not Document Nos. 62095, 66458, 66932, 83000 and 1239134 shall be carried forward, and free also from the memorial of this Order.
Attendance is required only by those who wish to object to the entry of the above-described Order.
IT IS FURTHER ORDERED, that this Order to Show Cause be served:
(a) at least 10 days before the hearing upon the above-named parties residing in this State in the manner provided by law for the service of Summons in a civil action.
(b) at least 14 days before the hearing upon each of the above-named nonresidents by sending a copy of this Order to the nonresidents post office address, by registered or certified mail return receipt requested;
(c) upon each of the above-named parties who cannot be found by two weeks published notice and by sending a copy of this Order at least 14 days before the hearing by first class mail to the last known address of the party and by sending another copy of this Order at least 14 days before the hearing by first class mail to the address of such party as stated on the Certificate of Title if an address is so stated;
(d) upon a dissolved, withdrawn, or revoked business entity governed by Minn. Stat, Chp. 302A, 303,317A, 322A, 322B, or 323 in the manner provided by Minn. Stat 5.25.
