LIENOR: Oakdale Stone Ridge Court Homes Association, Inc., a Minnesota nonprofit corporation.

AMOUNT DUE AND CLAIMED TO BE DUE TO THE ASSOCIATION ON THE LIEN DESCRIBED HEREIN, ON THE DATE OF THIS NOTICE: $7,246.70.

Said amount includes unpaid annual assessment installments (as accelerated by the Association), late fees, a maintenance assessment, and costs of collection and attorney’s fees incurred by the Association (all of said unpaid amounts are collectively referred to hereinafter as the “Debt”), all as assessed to and levied against said property by the Association pursuant to the Declaration, the Bylaws, and/or Minnesota Statutes Chapter 515B (“Chapter 515B”). Pursuant to Chapter 515B and the Declaration, the Debt creates a lien in favor of the Association against said property.

Pursuant to the Declaration, the Bylaws, and/or Chapter 515B, the Lienee is financially obligated to pay to the Association the Debt, as well as all assessments and/or installments thereof, late fees, costs of collection and foreclosure, attorney’s fees incurred by the Association in collection of the Debt and in foreclosure of the Association’s lien against said property, and all other amounts, which the Association assesses to and levies against said property from and after the date of this Notice, which additional amounts are part of said lien and are subject to this foreclosure.

DATE AND PLACE OF RECORDING OF LIEN: The verified Lien Statement in favor of the Association is dated July 18, 2012, and was recorded in the Recorder’s office on July 31, 2012, as Document No. 3899537.

All pre-foreclosure requirements have been complied with by the Association. There are no actions or proceedings instituted at law by the Association to recover the Debt or any part thereof. The Lienee has not been released from his personal obligation to pay the Debt.

Pursuant to the power of sale granted by the Lienee in taking title to said property, as provided in the Declaration and Chapter 515B, said lien will be foreclosed by the sale of said property by the Sheriff of Washington County, Minnesota, at the office of the Washington County Sheriff, Washington County Law Enforcement Center, 15015 – 62nd Street North, Stillwater, Minnesota, on December 11, 2012, at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for all unpaid assessments or installments thereof, late fees, costs of collection and foreclosure, attorney’s fees, and all other amounts, assessed to and levied against said property by the Association through the date of said sale. Notice is hereby given that the Stillwater City Council will meet on Tuesday, December 4, 2012 at 7:00 p.m. in the Council Chambers at Stillwater City Hall, 216 North 4th Street to consider the new National Guard Armory and City Fire Station facilities proposed to be constructed immediately northwest of the intersection of Myrtle Street and Maryknoll Drive in the 13000 Block on County Road 12 (aka 75th Street).  The Council will specifically consider: 1) annexation of an 18.92 acre property; 2) rezoning of the property from AP, Agricultural Preservation to RB, Two-Family Residential; 3) zoning ordinance amendment to allow armories and fire stations in the RB Zoning District by Special Use Permit; 4) Special Use Permit for the National Guard armory; and 5) Special Use Permit for the City of Stillwater Fire Station; and any related variances.  Case No. 2012-04.

NOTICE OF MORTGAGE FORECLOSURE SALE
Date: November 15, 2012
1. A default has occurred in the conditions of that certain mortgage executed by Reid L. Linwood, a single person, and Robert L. Linwood, a married person, as mortgagors, in favor of The RiverBank, a Minnesota banking corporation, as mortgagee, dated September 7, 2007, and recorded on October 9, 2007, as Document No. 3665258, as assigned to Royal Credit Union, a Wisconsin state chartered credit union, by that certain assignment of mortgage, dated October 14, 2011, and recorded on October 31, 2011, as Document No. 3860132, both in the Office of the County Recorder in and for Washington County, Minnesota (collectively, “Mortgage”). The land described in the Mortgage is not registered land.
2. The original principal amount secured by the Mortgage was: $117,200.00.
3. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.
4. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage and all notice and other requirements of applicable statutes.
5. As of the date of this notice, the amount due on the Mortgage is: $118,700.94.
6. Pursuant to the power of sale in the Mortgage, the Mortgage shall be foreclosed, and the land located at 6401 207th Street North, Forest Lake, Minnesota 55025, Property Tax ID No. 21.032.21.23.0059, and legally described as follows: Lot Sixteen (16), Block Nine (9), Sterling Oaks, CIC No. 209, Washington County, Minnesota (“Property”), shall be sold by the Sheriff of Washington County, Minnesota, at public auction on January 3, 2013, at 10:00 a.m., at the Washington County Sheriff’s Office: 15015 – 62nd Street North, Stillwater, Minnesota 55082.
7. The time allowed by law for redemption by mortgagors or mortgagors’ personal representatives or assigns is six (6) months after the date of sale.
8. The mortgagors must vacate the Property on or before 11:59 p.m. on July 5, 2013, if the Mortgage is not reinstated under Minn. Stat. § 580.30 or the Property is not redeemed under Minn. Stat. § 580.23.
9. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGORS, THE MORTGAGORS’ PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINN. STAT. § 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
10. The mortgagors released from financial obligation on the Mortgage are: None.

Notice is given that an Application for informal probate of Will and informal Appointment of Personal Representative was filed with the Registrar, along with a Will dated August 12, 1993. The Registrar accepted the application and appointed James Eugene Dahlby, whose address is 12396 W. Hildreth Road, Hayward, WI, 54834 to serve as the personal representative of the decedent’s estate.

Any heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Any objection to the appointment of the personal representative must be filed with the Court, and any properly filed objection will be heard by the Court after notice is provided to interested persons of the date of hearing on the objection.

Unless objections are filed and unless the Court otherwise orders, the personal representative has full power to administer the Estate, including, after thirty (30) days from the date of issuance of letters testamentary, the power to sell, encumber, lease or distribute any interest in real estate owned by the decedent.

Notice is further given that (subject to Minn. 524.3-801) ALL CREDITORS having claims against the decedent’s estate are required to present the claims to the personal representative or to the Court within four (4) months after the date of this notice or the claims will be barred.

Summary of Amendment to the Town Code
Amendment to add Section 10.5 – Home Occupation Interim Use

The Town Board of the Town of West Lakeland has adopted a revision to the Town Code by adding section 10.5 to the Town Code relating to the Home Occupation Interim Use.

Purpose. The purpose of the amendment is to authorize certain home occupation uses which the Town Board deems appropriate in a rural setting. The ordinance establishes a new category of home occupation use that applies to certain unique properties that do not qualify for a standard home occupation permit. The ordinance still requires the applicant to live on the property but allows for very limited retail activity. The Town Board must determine that the proposed use will not impose unreasonable costs on the public. The Town Board may place consitions on the proposed use to protect the neighbors and the public.

Penalty. Any person , firm or corporation violating the provisions of the code amendment, upon conviction thereof shall be guilty of a misdemeanor and/or the Town may seek injunctive relief.

Availability of full text of amendment. A copy of the entire text of the code amendment is on file with the Town Clerk and may be inspected during normal business hours.

The Town Board of the Town of West Lakeland has approved this Summary on this 12th day of November, 2012 and has determined that the summary clearly informs the public of the intent and effect of the code amendment.

The petition represents that the decedent owned property omitted from a previous probate proceeding. The petition requests the Court to determine the descent of such property and assign the property to the persons entitled.
Any objections to the petition must be raised at the hearing or filed with the Court prior to the hearing. If the petition is proper and no objections are filed or raised, the petition will be granted.
Notice shall be given by publishing this Notice and Order as provided by law and by mailing a copy of this Notice and Order to each interested person by United States mail at least 14 days before the time set for the hearing.
