Auto Club Insurance Association (Auto Club) moves for leave to intervene as a Plaintiff in this action, in order to assert the claims set forth in its Complaint, of which a copy is hereto attached, on the grounds that the claims asserted by State Farm against each Defendant is the same claim Auto Club has against Defendants Pa Dra Chang, George Yang, Wa Yang and Gary Yang, and contains the same question of law and fact which are common to the main declaratory judgment action. In the absence of objection by an existing party to the action within 30 days after service thereof upon the party, such intervention shall be deemed to have been accomplished pursuant to Minn.Civ.P. NOTICE IS HEREBY GIVEN that the Planning Commission for the City of Oak Park Heights, Washington County, Minnesota shall hold a public hearing, at the direction of the City Administrator, upon the application of Phillips Architects for a Conditional/Interim Use Permit to allow automobile sales & service at 14702 60th St. N., City of Oak Park Heights, County of Washington and State of Minnesota.

The public hearing shall be held before the Planning Commission on Thursday, October 11, 2012 at 7:00 o’clock p.m. at the City Hall, 14168 Oak Park Blvd. N., Oak Park Heights, Minnesota 55082. All written and oral comments will be considered.

Review of the findings and recommendation of the Planning Commission is anticipated to be held by the City Council on Tuesday, October 23, 2012 at 7:00 o’clock p.m. at the City Hall

AN ORDINANCE AMENDING CHAPTER 113 OF THE CODE
OF ORDINANCES OF THE CITY OF LAKELAND
RELATIVE TO ALCOHOL REGULATIONS

THE CITY COUNCIL FOR THE CITY OF LAKELAND DOES ORDAIN:

Section 1: Amendment. Chapter 113 of the Code of Ordinances is hereby amended as follows:
To delete Section 113.06 Persons Ineligible for License in its entirety and substitute the following therefor:
113.06 PERSONS INELIGIBLE FOR LICENSE.

(A) Persons. No license shall be granted to any person who is:

(1) Not at least 21 years of age;

(2) Not the proprietor of the establishment for which the license is issued;

(3) A person convicted of violating any law relating to the sale of 3.2% malt liquor or of intoxicating liquor within a period of 5 years prior to the date of the application; or

(4) The owner or holder of, or to whom there is hereafter issued, a Federal Liquor Dealer’s Special Tax Stamp for the sale of intoxicating liquor at any place, unless there has also been issued to that person a license to sell intoxicating liquor at the place.

(5) No license shall be granted to or held by any person made ineligible for such a license by state law.
To delete Section 113.07 Places Ineligible for License in its entirety and substitute for following therefor:
113.07 PLACES INELIGIBLE FOR LICENSE.
(A) Places.
(1) No license of any kind shall be granted for any premises where a licensee, or his or her agent, servant, or employee has been convicted of a violation of this code or applicable state law, or where any license hereunder has been revoked for cause, until 1 year has elapsed after the conviction or revocation, or a shorter period of time as the Council, in its discretion, may establish.
(2) No license shall be granted for operation of any premises upon which taxes, assessments, or other financial claims of the city are delinquent and unpaid.
(3) No license shall be issued for any place or for any business ineligible for such a license under state law.
To delete Section 113.40 Ineligible Persons and Places in its entirety and substitute the following therefor:
